BY ARIANNA PICKARD, Tulsa World

A Tulsa County judge declared a mistrial in a murder trial Wednesday after learning that witness testimony about a gun-like hand gesture made by the defendant was new evidence to attorneys for both sides, the attorneys say.

District Judge Sharon Holmes ruled that Stephen Kyle Scyffore’s case should be tried later in front of a new jury to allow his counsel time to prepare a defense to evidence about the alleged hand gesture, attorneys told the Tulsa World on Thursday.

Scyffore, 25, is charged with first-degree murder in the death of 31-year-old Leslie Griffin.
